HOW TO ENTER:
Complete the official registration form at www.sustainstores.com and click on "Submit". You must provide all information requested to receive an entry into the contest. contest begins at 12:00:01 AM (EST) on March 9, 2009 and ends at 11:59:59 PM (EST) on June 1, 2009 ("Promotion Period"). Limit one entry per person per household. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the holder of the e-mail account. Use of automated devices not valid for entry. Entries become the exclusive property of the Sponsor and will not be returned.

No purchase or payment is necessary to enter. Limit one entry per person per household. A random drawing of all eligible registrants will occur within 5 business days after the close of each drawing. The contest closing dates are: $500 shopping spree, March 21, 2009, Vers MP3 Docking Station give away, April 22, 2009 Voltaic Systems Back Pack give away June 1, 2009, Winners will be notified by email within 15 business days and be required to send shipping information in a return email. To receive a list of winner's names, send a self-addressed, stamped envelope to Sustain " Opening Prize" Giveaway, 3724 Frankfort Avenue, Loisville, Kentucky 40207. The $500 shopping spree is redeemable in the Louisville, Kentucky store location only.The odds of winning depend on the number of eligible entries received and submitted in accordance with the rules.
Open to legal residents of the United States, except employees and their immediate families of Sustain and its affiliates, subsidiaries, parent, and advertising and promotion agencies. You must be 18 years of age or older at the time of contest drawing to win. Winners may be required to submit a signed affidavit certifying their eligibility within 30 days of notification. Failure to submit a properly completed affidavit may result in selection of an alternate winner. All federal, state, and local laws and regulations apply. Void where prohibited or restricted by law. All federal, state, and local taxes are the sole responsibility of the winner. Retail prize value will vary; a 1099 form will be filed, when applicable, with the IRS in accordance with IRS regulations.
By completing and submitting a registration for Sustain’s Giveaway, the registrant agrees to abide by the terms of these official rules and the decisions of Sustain, which are final and binding on all matters pertaining to the giveaways. All entries become the property of Sustain and will not be returned. Sustain will arrange for delivery of all prizes. Any prize notification or prize that is returned as undeliverable may result in the awarding of that prize to an alternate winner, at Sustain’s sole discretion. Except where prohibited by law, each winner consents to the use of their name and entry (with the exception of the winner's contact information, including address, telephone number and email address) in any manner by Sustain and its advertising and promotion agencies without further compensation. Sustain and its affiliates, subsidiaries, divisions, and related companies shall not be responsible for any damages, taxes, or expenses that any winner might incur as a result of Sustain’s Giveaway or receipt of any prize. All winners accepting prizes agree that all prizes are awarded on the condition that Sustain and its agents, representatives, affiliates, and employees will have no liability whatsoever for any injuries, losses, or damages of any kind resulting from acceptance, possession, or use of the prizes. Each winner further acknowledges that Sustain is not responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness. No winner may make any substitutions or transfers of any prize. Sustain reserves the right to substitute cash or a similar prize of equal or greater value.

Entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. Authorized account holder is deemed to be the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Each potential winner may be requested to provide Sustain with proof that the potential winner is the authorized account holder of the email address associated with the potentially winning entry. Sustain may cancel or suspend the giveaway and will have no liability whatsoever if for any reason the giveaway is not capable of running as planned, including infection, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Sustain. Sustain reserves the right at its sole discretion to disqualify any individual who corrupts or affects the administration, security, fairness, integrity, or proper conduct of the giveaway or tampers with the entry process, and to cancel, terminate, modify, or suspend the giveaway. Sustain assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sustain is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sustain on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to registrants' or any other person's computer related to or resulting from participation or downloading any materials in the giveaways. D-Link's Giveaway and the rights and obligations of Sustain and registrants will be governed and controlled by the laws of the State of Kentucky, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of Kentucky, County of Jefferson. The parties consent to the jurisdiction of the state courts of Kentucky and federal court located within such state and county with respect to any action, dispute or other matter pertaining to or arising out of the Sustain Giveaway.

EACH REGISTRANT FURTHER AGREES THAT SUSTAIN, ITS SUBSIDIARIES, AGENTS, AFFILIATES, PARENT, EMPLOYEES, OFFICERS AND DIRECTORS SHALL HAVE NO LIABILITY WHATSOEVER FOR, AND REGISTRANT AGREES TO INDEMNIFY AND HOLD HARMLESS SUCH PARTIES FROM ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THE GIVEAWAY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUSTAIN, ITS SUBSIDIARIES, AGENTS, AFFILIATES, PARENT, EMPLOYEES, OFFICERS AND DIRECTORS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ALLEGEDLY SUSTAINED OR ARISING OUT OF THE GIVEAWAY, YOUR USE OF OR RELIANCE ON THE GIVEAWAY OR ANY OF THE INFORMATION OR MATERIALS AVAILABLE FROM THE GIVEAWAY, INCLUDING THE PRIZE, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
CAUTION: ANY ATTEMPT BY AN REGISTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SUSTAIN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH REGISTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
